TERMS OF SERVICE
- Application of terms and conditions of sale
By completing the application process and submitting a deposit to either Prepifly Pte Ltd or The Flight school of Gwinnett LLC, the customer represents and warrants that customer has the requisite legal capacity, authorization and consent (under the relevant laws in the relevant jurisdiction) to contract with Prepifly Pte Ltd and agrees to be bound by the Terms and Conditions.
The Terms and Conditions represent the complete and existing contract between customer and Prepifly Pte Ltd in relation to a purchase of any service or product. Any typographical, clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by Prepifly Pte Ltd or The flight school of Gwinnett LLC shall be subject to amendment without any liability on the part of Prepifly Pte Led. Customers below the age of 16 are to seek parental consent prior to making any purchases.
Prepifly Pte Ltd reserves the right to amend, add or vary any of these Terms and Conditions at any time without prior notice.
- Description of Product or Service
PREPIFLY PTE LTD has tried its best to ensure that the description of Product or Service materially resembles the final product delivered or service rendered to the customer. Accordingly, and due to limitations beyond PREPIFLY PTE LTD control, PREPIFLY PTE LTD is not responsible or liable for any differences or non-conformity of the products delivered or services rendered to the customer as compared to the description of the product or service displayed in the Website.
- Terms of payment
Prepifly Pte Ltd currently accepts only local Singapore Bank Transfers (in USD based on a pre-agreed rate) , Bank transfers in USD to a Bank of America Account or, Major credit cards.The bank that owns your credit card must support your payments in these currencies. You’ll be charged according to the prevailing exchange rate on the day that your bank posts the transaction. All prices quoted are exclusive of delivery charges, taxes/levies and other fees, unless otherwise stated. A 3% processing fee for all credit card transactions is applicable.
- Law and regulations
By transmitting an order via the website, the customer agrees that Singapore Law shall govern the Terms and Conditions and any contract or legal relationship formed on the basis of the order.
- Order acceptance
PREPIFLY PTE LTD will send and electronic acknowledgement to the customer within 24 hours upon successful submission of the deposit for the order.
- Order cancellation policy
6.1 There shall be no cancellation of or changes to customer’s order (upon submission of customer’s order and/or acceptance of customer’s order by PREPIFLY PTE LTD) without PREPIFLY PTE LTD written consent to the same. Customer undertake to indemnify PREPIFLY PTE LTD for any loss, damage, cost or expense suffered or incurred by PREPIFLY PTE LTD as a result of such cancellation of or changes to customer’s order. Customer hereby acknowledges that PREPIFLY PTE LTD shall incur such loss, damage, cost or expense in the event of any cancellation of and/or changes to customer’s order. Customer shall (without prejudice to any right or remedy available to PREPIFLY PTE LTD under the Terms and Conditions or general law) reimburse PREPIFLY PTE LTD such loss, damage, cost or expense on first demand by PREPIFLY PTE LTD. PREPIFLY PTE LTD further reserves the right to suspend the performance or any of its obligations under the Terms and Conditions until Customer indemnifies PREPIFLY PTE LTD accordingly.
6.2 PREPIFLY PTE LTD reserves the right to amend or cancel the customer’s order under any circumstances (“Event”) when PREPIFLY PTE LTD will incur loss, damage, cost or expense from performing its obligations. When such an Event occurs and PREPIFLY PTE LTD exercises its right to amend or cancel the customer’s order, the affected customer shall be notified duly and any payment that the customer has paid shall be refunded within reasonable timeframe. Such Event may include, but not limited to, any typographical, clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by PREPIFLY PTE LTD.
- Late delivery, non-delivery, partial delivery
Any time period indicated at the Website or any timeline, schedules or programs as to the training period or delivery of the products are estimates only. PREPIFLY PTE LTD shall undertake all reasonable efforts to ensure that the products are delivered to customer within the relevant period(s) specified at the website, or as agreed between PREPIFLY PTE LTD and customer. Notwithstanding the aforesaid, PREPIFLY PTE LTD is unable to guarantee that there shall be no late delivery or non-delivery of the products or services and PREPIFLY PTE LTD makes no representations or warranties that the products or services will be delivered within such period(s). Customer hereby agrees that PREPIFLY PTE LTD shall not liable for any loss, damage, and cost or expense suffered or incurred by customer as a result of such late delivery or non-delivery.
- Post trip expenses and refunds
There will be situations where included services would still require the customer to pay up front. (not limited to, car rentals, accommodation and fuel). In these cases, all claims that qualify for reimbursement must be submitted within 30 days from the last day of the trip’s itinerary.
The total amount claimable will be the amount that is indicated on the car rental voucher. Any additional expenses (car upgrades, road trip assistance, additional insurance etc) will not be entitled for claims.
8.1 Late Payment. See 9.4
- Disputed bill: This Clause sets out what you should do if you do not agree with any Charge contained in a bill.
9.1 Please inform us of your reasonable objections in writing before the payment date shown on your bill.
9.2 We will investigate the matter and will respond to you in writing within 30 days.
9.3 Prior to receiving our response, you do not have to pay the amount of the Charges that you have disagreed with. However, to be clear, you must pay all the other Charges which are not in dispute on a timely basis and in accordance with these Consumer General Terms & Conditions. If we agree that there is a mistake in your bill, we will adjust your next bill accordingly. However, if we do not agree, or if there is still any amount payable by you under that bill, you will have to pay the relevant amount as soon as possible, within the period stipulated by us in our response to you. Our decision will be final.
9.4 If you do not pay on time, we may charge you for any costs we incur in recovering the amount from you, and for late interest or our standard late payment fee as decided by us from time to time. Late interest is currently at 1.5% per month from the date the unpaid amount was due and payable, calculated on a daily basis. If you have paid a bill and wish to contest it subsequently, you must inform us of your reasonable objections in writing within 1 year from purchase.
9.5 If we do not receive an official response disputing any bill, we expect that the full payment be completed before any flight training begins. Any late payment fees will be applicable from the first day of flight training received.
Payment is due before the first training flight takes place. Late payment fees (see 9.4) are applicable if the full amount due is not received before the first training flight event. Prepifly Pte Ltd and its suppliers reserves the right to halt any further training if full payment is not received.
10.1. Invoicing. If there are errors in the invoice, the customer may dispute the bill (see 9) or Prepifly Pte Ltd may reopen the sale to claim and outstanding amounts that may have risen from the error. Late fees in this case (see 9.4) will be applicable 14 days from the first notice of any remaining outstanding amounts.
- Ownership of intellectual property, rights
All intellectual property rights existing in or in relation to the website and/or contents (including but not limited to any text, picture, image, sound, graphics, video and other data), the products and/or any information, images or drawings supplied with the products belong to PREPIFLY PTE LTD and/or the supplier/manufacturer of the products (where applicable). Nothing herein shall or shall be deemed to pass any such intellectual property right to customer.
PREPIFLY PTE LTD makes no representations or warranties of any kind (whether express or implied) as to the intellectual property rights in relation to the products and/or any information images or drawings supplied with the products.
Customer undertakes not to use or download any material from the website and/or its contents (including but not limited to any text, picture, image, sound, graphics, video and other data) without the first obtaining prior consent or a license to do so from PREPIFLY PTE LTD.
- Right of refusal
PREPIFLY PTE LTD reserves all rights to refuse products or services.
- Special Provisions
13.1 Flight what you need. Flight what you need is only available to ACCFGTG premium and above packages. A pilot with F16 flying experience must take up the viper driver ACCFGTG premium or better packages to qualify for the fly what you need promotion. Prepifly Pte Ltd and The Flight School of Gwinnett reserves all right to discontinue any training if the student is deemed unsafe, unprepared or is not flying in the best interest of himself. A pilot that has transferred from the F16 program to a transport based platform may be eligible for the ACCFGTG flight what you need program at the sole discretion of Prepifly Pte Ltd and The Flight School of Gwinnett.
